California has some of the most detailed contractor insurance and licensing requirements in the country. Understanding what you are legally required to carry — and what your clients and contracts will demand — is essential for any contractor operating in the state.
California State License Board (CSLB) Requirements
The California Contractors State License Board requires all licensed contractors to maintain:
Workers Compensation Insurance: Required for any contractor who employs workers — including subcontractors in certain circumstances. The CSLB requires a Certificate of Workers Compensation Insurance or a Certificate of Self-Insurance.
Contractor License Bond: A $25,000 surety bond is required for all license classifications. This bond protects consumers from contractor fraud or failure to complete work.
Qualifying Individual Bond: If the qualifying individual (the person holding the license) is not an owner of the business, an additional $12,500 qualifying individual bond is required.
What General Liability Limits Do Clients Require?
Beyond state licensing requirements, your clients and contracts will typically require:
- General Liability: $1,000,000 per occurrence / $2,000,000 aggregate (minimum)
- Workers Compensation: Statutory limits per California law
- Commercial Auto: $1,000,000 combined single limit for owned vehicles
- Umbrella / Excess: $2,000,000 to $10,000,000 depending on the project and client
Public works contracts (federal, state, county, and city) often require Performance and Payment Bonds in addition to insurance.
Experience Modification Rate (EMR)
For contractors bidding on commercial projects, your Workers Comp Experience Modification Rate (EMR) is often scrutinized — particularly on large public works projects. An EMR above 1.0 can result in bid disqualification on some contracts.
Managing your EMR through proactive safety programs, prompt incident reporting, and effective claims management is a significant competitive advantage.
